The
chartered yacht complete with equipment
can be taken only once full payment has
been settled:
Booking
fee of 30% of the chartered fee.
Remaining 70% of charter fee six weeks prior to the chartered date.
A list of names of all passengers and copies of each passenger’s
passport.
(These details need to be handed to the Harbor Masters Office).
Payment can be made by visa card, master card or direct transfer of funds
to Zephyrus account. Details will be given once booking dates are confirmed.
A
security deposit of
$2,500 is made payable on the day of charter. Payment can be made in cash or with
credit card. The security deposit shall be fully refunded unless there is
any evidence of damage or any defect on the yacht or the yachts equipment
which is found during the take over of the yacht. In a case where there is
damaged or loss of on any particular parts of the yacht or the yacht itself
or equipment Zephyrus do shall retain the full amount or portion of the security
deposit to the value of repair or purchasing of new equipment or particular
parts of the yacht.
The
lessee must provide proof of a valid
boat license as well as VHF radio license
and provide details of all members on
the yacht. The lessee agrees to sail
in Croatian territorial waters and obey
all rules and regulations. The lessee
agrees to takeover the yacht at the designated
time and marina. When taking over the
yacht the lessee is obliged to look over
the yacht and examine the equipment and
condition of the yacht in accordance
with the inventory list. If any defects
are sighted on the yacht or its equipment
it will be noted on the condition report
but it does not give the lessee the right
to ask for a reduced charter fee.
If
the lessee fails to takeover the yacht
within 48hours without notification Zephyrus
doo has the right to forfeit the contract
and retain all monies paid.
The
lessee must operate the yacht, equipment
and sails with extreme care, check oil
levels daily and keep a boat log book
that is provided. The lessee agrees not
to rent or lend the boat to any other
persons, not to use the boat in any competitions
or for commercial purposes such as fishing
or sailing courses. The lessee agrees
not to use the boat in any unfavorable
weather conditions or under the influence
of alcohol or narcotics.
The
number of persons on the yacht must correspond
with the names of the member list and
the lessee must take full responsibility
for any consequence that may occur through
their own negligence.
In
case of an accident or damage to the
yacht or equipment during the trip the
lessee is obliged to inform Zephyrus
doo immediately. For any major incidents
the lessee must contact Zephyrus doo
as well as the Port Authority within
24 hours. Contact details are provided
with all other boat documents.
The
lessee on his/her own accord will bear
all costs of daily berthing in the port
or marina, fuel, oil, cleaning and all
other costs.
Zephyrus
agrees to hand over the yacht completely
equipped, cleaned and dry with full fuel
and water tanks at the agreed time and
place. If for any reason Zephyrus cannot
fulfill the agreed time or place within
four hours after the takeover time the
lessee has the right to ask for a money
refund for the amount of days he/she
could not use the yacht.
Zephyrus
agrees to supply all safety equipment.
We do however recommend that if you are
sailing with young children to supply
their own lifejacket as the sizing may
differ from the ones provided. This is
an extra precaution for the safety of
your child/children.
The
lessee agrees to return the yacht at
the agreed place and time with a full
fuel tank. The boat must be tidied and
all persons disembarked and luggage removed
prior to the inspection which may take
up to an hour. If it is not possible
for the yacht to be returned at the agreed
time or place the lessee must contact
Zephyrus doo as soon as possible to make
further arrangements. If due to bad weather
and the yacht cannot be returned on the
agreed day and time we recommend that
the yacht be returned to the marina the
night before disembarking.
There
are penalties for any reason the yacht
is not returned at the agreed time and
place.
The
lessee is obliged to report any faults
and damages that may have occurred to
the yacht both above and under the waterline
and equipment. The lessee is required
to return all documents of the yacht.
The
yacht, equipment and crew are fully insured
against third party damages. Insurance
covers all damage caused by weather or
other natural disasters but not damage
caused on purpose. If the lessee is found
to be negligent causing damage to the
yacht, the yachts equipment or third
party the lessee will be required to
pay Zephyrus doo all material and legal
costs.
If
an incident occurs it is the responsibility
of the lessee to inform the Harbor Master
and record the events and the estimation
of the damage. The lessee must also inform
Zephyrus doo immediately for insurance
purposes. If the lessee fails to report
the accident immediately the lessee will
be responsible for the cost of all damage.
Personal
belongings are not covered in the insurance.
Should
the lessee cancel the reservation for
yacht charter and cannot find some one
else to fulfill the contract Zephyrus
do has the right to retain,
